What is a Process Server?
Process Servers are people who, normally operate under a business profile or who are mandated to effect service of a process. The process is usually issuing or obtaining issued court or tribunal documents, (papers) giving them notice to attend at before a court or government body. Typical situations are Small Claims Court, Family Court, Landlord / Tenant Tribunals, Statements of Claim, Summons, Summons and Complaints and formal letters.
The documents (papers) normally are served under rules, specific to the document, and are left with the person or business. This can be the Defendant’s or Respondent’s home or place of employment. We have arranged to meet people who are agreeable or we have even run into situations where we have had (non-compliant) people served right in their vehicles at a red light! So each situation requires different tactics to effect the service. Other times, where permitted, it may be left with an adult person of the same household, or person at a place of employment, but rules must be adhered to make service proper.
What if you don’t know where a person lives? We use various tactics, eg. Social media, MTO drivers license searches, 411, to name a few to locate them. Often, information is developed. This comes from decades of learning investigative techniques to find, target and serve.
Once served, an Affidavit of Service is generated by us using the proper forms to provide proof of service, which is then sworn before a Commission for Taking Oaths. This document is provided to you as part of the process and is to be filed with the court. This service, filing, is also among the things we do upon request.
